GENERAL TERMS AND CONDITIONS OF SALE (GTC)

Art. 1 — Scope of application
These General Terms and Conditions of Sale (hereinafter "GTC") apply to all orders placed on the website www.995petrolhead.ch, operated by 995 Heritage Sàrl, Route de Lausanne 31, 1052 Le Mont-sur-Lausanne (UID: CHE-188.581.737).
By confirming an order, the customer unconditionally accepts the entirety of these GTC in the version in force at the time of the order. Any conflicting condition imposed by the customer is not binding on 995 Heritage Sàrl unless agreed in writing in advance.
The GTC may be modified at any time. The applicable version is the one published on the website at the time of the order.
Art. 2 — Products and compatibility
2.1 Product descriptions
The photographs, illustrations and technical descriptions on the website are provided for information purposes only. They do not constitute a contractual guarantee of exact conformity between the product shown and the product delivered, particularly due to manufacturing changes.
2.2 Compatibility responsibility
It is the customer's responsibility to verify the compatibility of the part with their vehicle before placing an order. 995 Heritage Sàrl encourages the customer to provide their vehicle registration document with vehicle details, chassis number (VIN) and type approval number when ordering.
Regardless of the order, our teams carry out a compatibility and homologation check before confirmation and dispatch. This check is intended to prevent assembly or approval errors.
If the customer provides their registration document and approval information and an incompatibility is identified on our part, a return will be accepted under the conditions of Art. 6.
If the customer does not provide this information despite our request, they are solely responsible for the compatibility check. No return for incompatibility will be accepted in this case.
Parts not approved for road use in Switzerland are sold exclusively for track or off-road use. It is the customer's responsibility to verify the legality of the intended use.
Art. 3 — Formation of contract
Products and prices published on the website constitute a commercial offer, subject to availability and accuracy of the information displayed.
The sales contract is concluded at the moment of payment validation by the customer. An order confirmation is sent automatically by e-mail. This confirmation acknowledges receipt of the order and does not constitute confirmation of the actual availability of the product.
995 Heritage Sàrl reserves the right to refuse or cancel any order in the event of out-of-stock, production discontinuation, manifest pricing error, or suspicion of fraud. In such cases, the customer is immediately informed and fully refunded.
Special orders
The nature of our business means that the vast majority of products are sourced to order or made to specification. These orders cannot be cancelled, modified, or returned once confirmed by 995 Heritage Sàrl, except under the conditions set out in Art. 6.
Art. 4 — Prices and payment
4.1 Prices
All prices are expressed in Swiss francs (CHF), inclusive of VAT at the applicable legal rate. 995 Heritage Sàrl reserves the right to modify its prices at any time. The applicable price is that displayed at the time of order confirmation.
4.2 Accepted payment methods
The following payment methods are accepted on www.995petrolhead.ch:
— Credit/debit card (Visa, Mastercard, American Express, Maestro) via Stripe — PCI-DSS secured processing, no banking data stored on our servers.
— TWINT — Swiss mobile payment solution.
— Klarna — deferred payment (within 30 days) or instalment payment, subject to creditworthiness validation by Klarna.
— Apple Pay / Google Pay — via digital wallets.
— Bank transfer (advance payment) — the order is dispatched upon receipt of full payment. Bank details and a QR invoice are sent by e-mail after order confirmation.
4.3 Payment security
All transactions are protected by SSL/TLS encryption (HTTPS). 995 Heritage Sàrl reserves the right to verify the validity of the payment method. In the event of suspected fraud, the order may be suspended or cancelled.
4.4 Retention of title
Ordered products remain the property of 995 Heritage Sàrl until full payment of the price has been received.
Art. 5 — Shipping costs and delivery times
5.1 Delivery zones
995 Heritage Sàrl delivers exclusively within Switzerland. International shipments are possible upon prior written request. For all shipments outside Switzerland, customs duties, taxes and VAT of the destination country are the sole responsibility of the customer.
5.2 Shipping costs (Switzerland)
— Free for orders from CHF 149.–
— CHF 10.– for orders below CHF 149.–
— International: on request, depending on weight, volume and destination.
5.3 Delivery times
Indicated times are given for information purposes and do not constitute a contractual commitment. A delivery delay does not give rise to any right to compensation.
— Available products: 3 to 21 business days on average.
— Made-to-order or custom products: 4 to 12 weeks. The indicative timeframe is specified on the product page or communicated by e-mail upon order confirmation.
5.4 Inspection upon receipt
The customer is required to check the condition and conformity of the goods immediately upon delivery.
— Transport damage: any visible damage must be reported with photos on the day of delivery to info@995petrolhead.ch. After this deadline, the goods are deemed to have been received in good condition.
— Reference error: any claim concerning an item not conforming to the order must be made in writing within 7 days of receipt.
Art. 6 — Right of return
6.1 Principle
Under Swiss law, there is no statutory right of withdrawal for online purchases. 995 Heritage Sàrl nevertheless grants, on a goodwill basis, a return period of 7 calendar days after receipt, subject to the strict conditions set out below.
Processing the return may require additional time.
6.2 Return conditions
For a return to be accepted, the following conditions must all be met simultaneously:
— Prior written agreement mandatory: no return is accepted without a written request to info@995petrolhead.ch and assignment of a return number (RMA) by 995 Heritage Sàrl.
— The part must be strictly new, unmounted, with no signs of use, in its original intact packaging suitable for resale.
— Electronic components: electronic parts whose original packaging has been opened, seal broken, or which have been tested or fitted, will under no circumstances be accepted for return or exchange.
— Registration document not provided: if the customer did not provide their registration document at the time of ordering despite our request, no return for incompatibility will be accepted.
6.3 Refund process
Refund is issued only after receipt of the returned part and full technical inspection by our teams.
— Return shipping costs: borne exclusively by the customer.
— Restocking fee: a flat fee of 20% of the part value may be deducted from the refund for any return due to change of mind or ordering error on the part of the customer.
— Refund timeframe: the refund is processed within 14 days of technical validation of the returned part.
Art. 7 — Warranty
7.1 Manufacturer warranty
New parts sold by 995 Heritage Sàrl benefit from the manufacturer's factory warranty, as a rule 2 years from the date of delivery.
7.2 Warranty exclusions
The warranty is void in the following cases:
— Defective assembly or assembly not in accordance with the manufacturer's instructions.
— Use on track, in competition, or under conditions not in accordance with the intended use.
— Unauthorised modification, conversion or intervention on the part.
— Negligence, insufficient maintenance or external damage.
— Non-compliance with these GTC.
7.3 Extent of warranty
The warranty of 995 Heritage Sàrl covers exclusively the replacement or refund of the defective part, after assessment. It does not cover under any circumstances labour costs, garage costs, replacement vehicle costs, towing costs or any other indirect costs.
The warranty is of the Bring-In type: the customer sends the part at their own expense to the address indicated by 995 Heritage Sàrl. Return shipping costs for the repaired or replaced part are borne by us if the warranty claim is confirmed.
Art. 8 — Liability
The liability of 995 Heritage Sàrl is limited to the amount of the relevant order. 995 Heritage Sàrl cannot be held liable for direct or indirect damage resulting from the use of a part, incorrect assembly carried out by the customer or a third party, or the non-conformity of the part to an unintended use.
In the event of force majeure (strike, incident, supply shortage, pandemic, etc.), the obligations of 995 Heritage Sàrl are suspended for the duration of the event, without this giving rise to any right to compensation.
Art. 9 — Data protection
Personal data collected in connection with orders is processed in accordance with the Swiss Federal Act on Data Protection (revFADP). For information on the processing of your personal data, please consult our Privacy Policy available at www.995petrolhead.ch.
Art. 10 — Jurisdiction and applicable law
These GTC are governed exclusively by Swiss law. In the event of a dispute between 995 Heritage Sàrl and a customer, the parties will endeavour to find an amicable solution. Failing that, the exclusive place of jurisdiction is 1052 Le Mont-sur-Lausanne, Switzerland.
